Prosecutors Not Asking For Death Penalty In Iraqi Murder Case----General Court-Martial Will Be Recommended
Prosecutors are asking military authorities to rule out the death penalty for a Camp Pendleton Marine accused of killing an Iraqi civilian.
Lance Cpl. Jerry Shumate Jr. appeared at his pretrial hearing Tuesday.
Shumate and seven other servicemen are charged with murdering a man in Iraq on April 26 and trying to cover it up.
Prosecutors Tuesday asked investigators to recommend a general court-martial for Shumate but not one ending in a death sentence.
