Jury fails to reach verdict in death penalty trial SANTA ANA, Calif. (AP) - A federal jury in Santa Ana has failed to reach a verdict in the death penalty trial of two Aryan Brotherhood leaders convicted of murder, racketeering and conspiracy.
Jurors made the announcement today in a note to the judge.
The same jury convicted Aryan Brotherhood leaders Barry "The Baron" Mills and Tyler "The Hulk" Bingham in July of murder, conspiracy and racketeering.
Jurors were then asked, in a separate trial, to determine whether Mills and Bingham should be sentenced to death or life in prison without possibility of parole.
After jurors indicated they were deadlocked, defense attorneys asked Judge David Carter to declare a mistrial, which would result in Mills and Bingham serving life sentences without parole. Prosecutors asked that the judge consider ordering the jurors to resume deliberations and try to break the deadlock.
